Marietta Recycling Faces Court

The company was denied an expansion of operations in Northeast Cobb and now has a court date with the city of Marietta.

First Marietta Recycling failed to win Cobb County approval to establish a metal scrap yard and transfer station in Northeast Cobb, and now the company has a court date with the city of Marietta. The city has cited the Marietta Recycling Center on Marble Mill Road with a violation of its noise ordinance and issued a court date of June 15. The city's noise ordinance provides for fines up to $1,000. Research into city records shows there have been numerous noise complaints about the Marble Mill Road facility over the years from Kennesaw Battle subdivision residents. Commissioners Scrap Marietta Recycling's Transfer Station

The board voted 4-0 against a special land-use permit for a scrap metal facility on Canton Road in Northeast Cobb.

The Cobb County Board of Commissioners voted 4-0 this morning against an application for a special land-use permit allowing Marietta Recycling to operate a metal scrap yard and transfer station on Canton Road next to the East Cobb Baseball complex. The commissioners followed the recommendation of the county Planning Commission, which voted May 3 against Marietta Recycling's proposal. Parks Huff, a partner of Sams, Larkin and Huff Law Firm, represented Snapfinger Properties/Marietta Recycling at the meeting. He told the board the facility would produce less traffic than the East Cobb Baseball property and would promote sustainability and recycling by scrapping up to 2,000 tons of metal a month. Marietta Recycling's Plans Scrapped

The Cobb Planning Commission voted 5-0 to deny the company's application to operate a metal scrap yard and transfer station on Canton Road.

The Cobb County Planning Commission this morning unanimously rejected an application for a special land-use permit allowing Marietta Recycling to operate a metal scrap yard and transfer station on Canton Road next to the East Cobb Baseball complex. The 5-0 vote against the application, formally made by Snapfinger Properties, means Marietta Recycling has 120 days to cease the operations at the site, which used to be Hope Lumber. Marietta Recycling had been placed on notice that it was violating code without the special use permit, and the enforcement was suspended until the Planning Commission acted, code enforcement officer Kim Wakefield told the commission.
