Marietta Recycling Faces Court

The company was denied an expansion of operations in Northeast Cobb and now has a court date with the city of Marietta.

First Marietta Recycling failed to win Cobb County approval to establish a metal scrap yard and transfer station in Northeast Cobb, and now the company has a court date with the city of Marietta.

The city has cited the Marietta Recycling Center on Marble Mill Road with a violation of its noise ordinance and issued a court date of June 15. The city's noise ordinance provides for fines up to $1,000.

Research into city records shows there have been numerous noise complaints about the Marble Mill Road facility over the years from Kennesaw Battle subdivision residents.

City Councilman Anthony Coleman, who represents the neighborhood, told the Marietta Daily Journal: "Their license needs to be revoked. The bottom line is it impacts the citizens' quality of life, and it's a nuisance. They have no regard or respect whatsoever for the community."

Marietta Recycling declined to comment.

According to the MDJ, the city's zoning director, Rusty Roth, said Marietta Recycling was cited May 18 for exceeding the noise level permitted under city code. The business had been warned several times about exceeding the noise limit, and therefore the city is taking Marietta Recycling to court, he said.

Meanwhile, Marietta Recycling has until mid-September to cease operations at its Northeast Cobb facility off Canton Road near Shallowford Road after the county Board of Commissioners May 17. That decision followed the and the .
